These Terms & Conditions are intended for Kaymara Luxury Travel’s website, proposals, booking confirmations, digital acceptance workflows, and client-facing communications. They are written for international guests, including travelers from the United States, the United Kingdom, Europe, Canada, Australia, and other markets, while preserving Kaymara’s legal foundation as a Peruvian company.
For clarity, the English version uses the terms “Traveler,” “Guest,” or “you” in place of the Spanish term “Cliente.” References to Kaymara, “we,” “us,” or “our” mean Corporación Kay N&B S.A.C., operating commercially as Kaymara Luxury Travel, unless expressly stated otherwise.
These Terms are designed to be commercially balanced: they protect Kaymara’s operational and legal position while setting clear expectations for guests booking private, high-end, tailor-made journeys in Peru and South America.
1. General Provisions
At Kaymara Luxury Travel, every journey is conceived as a bespoke creation: authentic, exclusive, and transformational. Our promise is to design experiences that go beyond the ordinary, with meticulous attention to detail, human care, cultural sensitivity, and excellent service standards at every stage of the journey.
These Terms & Conditions govern the booking, sale, organization, coordination, and delivery of travel services offered by Corporación Kay N&B S.A.C., doing business as Kaymara Luxury Travel (“Kaymara,” “the Company,” “we,” “us,” or “our”). Kaymara is organized under the laws of the Republic of Peru and operates in accordance with applicable Peruvian laws and regulations, including, where relevant, the Peruvian Civil Code, the Consumer Protection and Defense Code, the General Tourism Law, regulations issued by MINCETUR, and other competent authorities.
By confirming a reservation, making any payment, digitally accepting these Terms, signing a proposal or booking form, or participating in a journey arranged by Kaymara, the Traveler acknowledges that they have read, understood, and accepted these Terms & Conditions in full.
2. Definitions
For purposes of these Terms, the following definitions shall apply:
3. Nature of Kaymara’s Services
Kaymara designs and coordinates private, tailor-made travel experiences. Our journeys may include luxury accommodations, private guiding, transportation, flights, trains, lodges, cruises, yacht services, cultural encounters, community-based activities, culinary experiences, wellness moments, trekking, remote nature experiences, spiritual or ancestral ceremonies, access to archaeological sites, protected natural areas, and other exclusive or carefully curated services.
Kaymara may act as principal for certain services directly organized by the Company and as coordinator, agent, or intermediary for services provided by Independent Suppliers. Although we carefully select our partners and seek to work only with reputable providers, many services are performed by third parties that operate under their own rules, regulations, permits, insurance, liability standards, and terms and conditions.
The Traveler acknowledges that tailor-made travel in Peru often involves living cultures, remote landscapes, high-altitude destinations, variable weather, government-managed permits, local community decisions, and limited availability of certain premium services. For this reason, flexibility is an essential part of the travel experience.
4. Itineraries and Experiences
Published itineraries, sample journeys, website descriptions, brochures, and proposal materials are indicative and inspirational unless expressly confirmed in writing as final. They may be adjusted before or during the trip for operational, weather-related, cultural, logistical, conservation, availability, security, community, or safety reasons.
Kaymara will always use reasonable efforts to preserve the spirit, standard, integrity, and overall quality of the contracted experience. However, specific elements may be modified due to circumstances beyond Kaymara’s reasonable control, including decisions by local communities, cultural custodians, authorities, protected area administrators, rail operators, airlines, hotels, lodges, cruise companies, or other Independent Suppliers.
Kaymara designs experiences that may include immersion in local communities, ancestral ceremonies, access to special or restricted sites, protected natural areas, cultural, gastronomic, adventure, nature, wellness, or spiritual experiences of an exclusive character. Because these elements are authentic and living, certain aspects may vary. Such variations shall not constitute a breach of these Terms where Kaymara has acted reasonably and in good faith to preserve the quality of the journey.
5. Reservations and Confirmation
A reservation shall be considered formally confirmed only when all of the following conditions have been met:
Certain services require immediate and non-refundable payments to secure availability. These may include, without limitation, domestic or international flights, train tickets, Machu Picchu and Inca Trail permits, special entrance tickets, boutique hotels, exclusive lodges, cruises, yachts, charter services, private experiences, high-demand restaurants, and limited-capacity services.
The person making the booking represents that they are authorized to accept these Terms on behalf of all Travelers included in the reservation. The Lead Traveler is responsible for ensuring that each Traveler receives, reads, understands, and complies with these Terms.
6. Client-Requested Modifications
Because most journeys designed by Kaymara are highly personalized and require coordination with multiple national and international suppliers, any modification requested by the Traveler after confirmation may result in fare differences, administrative charges, operational restrictions, and penalties imposed by third parties.

Kaymara will inform the Traveler of applicable costs, restrictions, and feasibility before proceeding with any requested modification whenever reasonably possible. No modification shall be considered confirmed until Kaymara has issued written confirmation and any applicable additional payments have been received.
7. Payment Policy
Unless otherwise agreed in writing, all payments shall be made in U.S. Dollars (USD). Accepted payment methods may include international bank transfer, credit card, debit card, PayPal, Western Union, MoneyGram, or other platforms authorized by Kaymara.
Payments made by credit card, debit card, wire transfer, or digital platforms may be subject to bank charges, processing fees, currency conversion costs, intermediary bank fees, or financial commissions. Such costs shall be borne by the Traveler unless Kaymara expressly agrees otherwise in writing.
The final balance of the journey must generally be paid at least ninety (90) calendar days before the start date of travel, unless specific conditions have been agreed in writing. For bookings made within ninety (90) days of departure, full payment may be required at the time of booking.
If any payment is not received by the due date, Kaymara may treat the reservation as cancelled by the Traveler and apply the cancellation provisions set out in these Terms. Kaymara may also withhold travel documents, vouchers, confirmations, or final itinerary materials until all amounts due have been fully paid.
8. Travel Design Fee
As part of its bespoke service model, Kaymara may charge a Travel Design Fee to cover the professional work involved in the research, curation, operational coordination, itinerary development, supplier selection, creative design, and strategic planning of tailor-made experiences.
Unless expressly stated otherwise in writing, the Travel Design Fee:
The Travel Design Fee does not guarantee availability of any specific hotel, service, experience, permit, guide, train, cruise, or supplier until the relevant booking has been confirmed in writing and the applicable payments have been made.
9. Flights and Transportation
Air, rail, maritime, and land transportation services are operated by Independent Suppliers and are subject to their own policies, schedules, conditions of carriage, liability rules, safety standards, and cancellation terms.
Airline tickets, train tickets, cruise tickets, ferry tickets, and certain transport services may be non-refundable, non-transferable, and subject to change penalties. Fares and schedules may change until final ticketing or due to unilateral decisions by airlines, rail operators, cruise companies, or transport providers.
Kaymara shall not be responsible for delays, cancellations, overbooking, strikes, bankruptcies, insolvency, route changes, schedule changes, missed connections, baggage issues, operational disruptions, or interruptions attributable to transportation suppliers or other third parties. Kaymara will provide reasonable assistance where possible, but additional costs resulting from such events shall be the responsibility of the Traveler unless recoverable from the relevant supplier or covered by insurance.
10. Cruises, Yachts, and Marine Excursions
Cruises, yacht experiences, river expeditions, maritime excursions, and related services are governed by the terms and conditions established by each vessel owner, cruise company, captain, or marine operator.
Kaymara may act as coordinator and point of contact but does not directly control nautical operations, navigational decisions, weather-related route changes, safety determinations, port authority decisions, water levels, mechanical issues, crew decisions, or maritime regulations.
The captain, vessel operator, or competent maritime authority shall have final authority over safety-related decisions. Changes to routes, timing, landing points, wildlife observation, navigation, or activities due to safety, weather, water level, or operational considerations shall not constitute a breach of these Terms.
11. Cancellations and Refunds
All cancellation requests must be submitted in writing to Kaymara at the email address indicated in the Contact section of these Terms. The effective date of cancellation shall be the date on which Kaymara receives the written request.
Because tailor-made journeys require substantial advance commitments with suppliers, cancellation terms will depend on the type of journey, timing, and the non-recoverable costs already incurred.
11.2 Group Journeys
Group rates are based on shared costs, minimum passenger numbers, and supplier terms negotiated in advance. Individual cancellations after confirmation may not generate a right to refund, may affect the pricing of the remaining participants, and may trigger external penalties. If the cancellation of one or more participants causes the group to fall below the minimum number required, Kaymara may reprice the journey or apply applicable cancellation conditions.
12. No Show Policy
Failure by the Traveler to appear for any booked service, including flights, transfers, trains, excursions, activities, accommodations, cruises, yacht services, restaurants, wellness appointments, or private experiences, shall be considered a “No Show.”
Unless expressly authorized by the relevant supplier, services not used due to reasons attributable to the Traveler shall not give rise to any refund, credit, compensation, or rescheduling. Kaymara shall not be responsible for losses arising from delays, personal planning errors, missed alarms, failure to follow instructions, late arrival, incorrect documentation, or failure to appear at the time and place communicated by Kaymara or the supplier.
13. Postponements and Transfers
The Traveler may request postponement of the journey by notifying Kaymara in writing at least sixty (60) calendar days before the scheduled start date. Amounts paid may be applied to a new travel date within twelve (12) months, subject to availability, seasonal differences, supplier approval, fare differences, operational feasibility, and administrative charges.
Reservations may be transferred to another person by notifying Kaymara at least thirty (30) calendar days in advance, subject to operational approval and supplier conditions. Certain services, including but not limited to flights, train tickets, permits, entrance tickets, cruises, and named reservations, may be non-transferable.
14. Last-Minute Bookings
Bookings made on a last-minute basis or under special promotional conditions may be partially or fully non-refundable due to the immediate and irreversible operational confirmations required. Kaymara will inform the Traveler of any special conditions applicable to such bookings whenever possible before confirmation.
15. Travel Documents and Entry Requirements
It is the Traveler’s sole responsibility to obtain, verify, and carry all required travel documents, including:
Kaymara may provide general guidance as a courtesy, but such guidance shall not replace the Traveler’s responsibility to verify current requirements with the relevant embassy, consulate, airline, government authority, or medical professional. Kaymara shall not be responsible for denied boarding, denied entry, delays, fines, cancellation costs, or loss of services resulting from incomplete, invalid, expired, or incorrect documentation.
16. Altitude, Health, and Physical Activities
Many destinations operated or arranged by Kaymara are located at high altitude, in remote environments, or in areas with complex geography, variable weather, uneven terrain, and limited access to medical facilities. By confirming a reservation, the Traveler declares that they are in suitable physical and medical condition for the selected itinerary.
The Traveler must inform Kaymara in advance of any relevant medical condition, physical limitation, allergy, disability, dietary restriction, pregnancy, medication, mental health consideration, mobility concern, or treatment that may affect participation in the journey. Kaymara will reasonably assess operational feasibility in relation to the safety and wellbeing of the Traveler, the group, staff, and local partners.
Kaymara reserves the right to recommend adjustments, require medical clearance, modify certain activities, or decline participation in specific experiences where safety or operational feasibility may be compromised.
17. Travel Insurance
Kaymara strongly recommends that every Traveler purchase comprehensive travel insurance before travel. For certain journeys, travel insurance may be mandatory.

The Traveler acknowledges that they travel at their own risk if they do not obtain adequate insurance coverage. Kaymara shall not be responsible for costs, losses, or expenses that could have been covered by appropriate insurance.
18. Mandatory Insurance for Special Expeditions
For certain programs involving high-altitude trekking, remote expeditions, wilderness environments, Amazon travel, adventure activities, marine activities, or destinations with limited medical access, Kaymara may require proof of adequate travel insurance as a condition of participation.

Failure or refusal to obtain required coverage may prevent the Traveler from participating in certain experiences, without entitlement to a refund for services lost as a result.
19. Medical Disclaimer
Kaymara does not provide medical services, medical diagnoses, treatment recommendations, clinical advice, or professional health assessments. Any information provided by Kaymara regarding altitude, vaccination, food safety, physical activity, climate, travel conditions, or destination risks is for general informational purposes only and does not replace evaluation by a qualified healthcare professional.
The Traveler is solely responsible for consulting medical professionals regarding their fitness to participate in the contracted itinerary and for carrying any medication, prescriptions, medical devices, or health documentation required for their personal wellbeing.
20. Passenger Conduct
All Travelers are expected to maintain respectful conduct toward fellow Travelers, Kaymara staff, guides, drivers, hosts, local communities, cultural custodians, authorities, suppliers, wildlife, and the cultural and natural heritage visited during the journey.
Kaymara reserves the right to suspend, limit, or terminate the participation of any Traveler whose conduct:
In such circumstances, no refund shall be due for unused services, and the Traveler shall be responsible for any additional costs arising from removal, alternative arrangements, damages, fines, or early termination of participation.
21. Weather and Operational Conditions
Many experiences offered by Kaymara take place in natural environments subject to variable weather and operational factors beyond the Company’s control. The execution of activities may be affected by intense rain, snow, flooding, river levels, reduced visibility, landslides, road closures, route restrictions, conservation measures, safety decisions, government orders, or determinations by competent authorities or suppliers.
In such circumstances, Kaymara may modify routes, schedules, activities, accommodation order, transportation arrangements, or experiences, substituting them with reasonably equivalent alternatives where possible. Such changes shall not constitute a breach of these Terms where they are made for safety, operational feasibility, regulatory compliance, conservation, or guest wellbeing.
22. Cultural, Spiritual, and Ancestral Experiences
Some itineraries may include traditional ceremonies, cultural activities, community encounters, ancestral practices, wellness experiences, or spiritual rituals facilitated by local communities, cultural leaders, spiritual guides, healers, artisans, or independent facilitators.
These activities are cultural, educational, symbolic, and experiential in nature. Kaymara does not guarantee any spiritual, emotional, therapeutic, medical, psychological, or personal outcome arising from participation in such experiences.
Participation is voluntary and undertaken at the Traveler’s own discretion. Travelers are expected to approach these experiences with respect, humility, cultural sensitivity, and awareness that certain activities may be adapted, restricted, or cancelled according to community decisions, ceremonial protocols, local customs, or safety considerations.
23. Limitation of Liability
Kaymara acts as organizer, designer, coordinator, and/or intermediary for services that may be performed by Independent Suppliers. Although Kaymara carefully selects its partners, it shall not be responsible for acts, omissions, negligence, delays, failures, accidents, cancellations, overbooking, changes, insolvency, misconduct, or default by Independent Suppliers, except to the extent required by applicable law.
Kaymara shall not be liable for events of Force Majeure, natural phenomena, social conflicts, government closures, roadblocks, pandemics, restrictions, security situations, or circumstances outside its reasonable control.
Kaymara’s responsibility is limited to the reasonable coordination of services contracted directly with the Company. To the maximum extent permitted by applicable law, Kaymara’s total liability shall not exceed the amount effectively paid by the Traveler to Kaymara for the affected services.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation would be prohibited by applicable law.
24. Adventure Activities and Assumption of Risk
Certain experiences may include trekking, hiking, climbing, navigation, kayaking, horseback riding, cycling, remote routes, high-altitude walks, wildlife observation, jungle activities, marine activities, or other physically demanding or adventure-based activities.
The Traveler acknowledges and accepts the inherent risks associated with such activities, which may include injury, illness, altitude sickness, fatigue, falls, weather exposure, wildlife encounters, transportation delays, limited medical access, evacuation difficulties, and environmental hazards.
Participation is voluntary and takes place under the Traveler’s own responsibility. Kaymara may require Travelers to follow guide instructions, safety briefings, equipment requirements, and route decisions. Failure to comply may result in exclusion from the activity without refund.
25. Valuables and Personal Property
The Traveler is responsible for the custody and safekeeping of personal documents, passports, visas, cash, credit cards, jewelry, watches, electronic devices, cameras, photographic equipment, luggage, medication, and all other personal belongings throughout the journey.
Kaymara shall not be responsible for loss, theft, damage, misplacement, disappearance, or deterioration of personal property occurring during services operated by third parties, transfers, accommodations, public areas, activities, or travel movements.
Travelers carrying high-value personal items are strongly encouraged to purchase appropriate insurance coverage and to use available safes or secure storage where provided.
26. Travel with Minors
Travelers under the age of eighteen (18), or the applicable age of majority in their jurisdiction, must travel with their parents, legal guardians, or persons duly authorized under applicable law.
Parents or legal guardians are solely responsible for providing all documentation required by immigration authorities, airlines, transportation operators, hotels, protected areas, and other competent entities. Such documentation may include birth certificates, notarized authorizations, custody documents, passports, visas, or other legal approvals.
Kaymara may request additional documentation where necessary to comply with applicable law, supplier requirements, or child safety protocols.
27. Accessibility, Mobility, and Special Requirements
Kaymara will make reasonable efforts to accommodate Travelers with mobility limitations, disabilities, dietary requirements, allergies, or other special needs when such needs are disclosed in advance and when operationally feasible.
However, many destinations in Peru involve uneven terrain, historic sites, altitude, stairs, narrow streets, remote routes, boats, trains, small lodges, and infrastructure that may not meet accessibility standards found in other jurisdictions. Kaymara cannot guarantee full accessibility unless expressly confirmed in writing for the specific itinerary.
Travelers are responsible for informing Kaymara of any relevant needs before booking so that the feasibility and suitability of the itinerary can be assessed.
28. Equivalent Service Substitution
If a service originally confirmed cannot be provided due to circumstances beyond Kaymara’s reasonable control, Kaymara may substitute it with another service of equivalent or higher category, service level, or value where reasonably possible.
Kaymara will seek to preserve the essence, standard, and overall quality of the contracted experience. The inability to provide an identical service shall not constitute a breach of these Terms where Kaymara has acted in good faith and provided a reasonable alternative.
29. Machu Picchu, Inca Trail, Permits, and Restricted Access
Certain experiences in Peru, including Machu Picchu, the Inca Trail, protected archaeological sites, national parks, and restricted-access areas, are governed by public authorities, conservation rules, capacity limits, timed entries, route assignments, circuit regulations, permit conditions, and third-party operating requirements.
Kaymara does not control the availability, timing, route allocation, access rules, circuit assignment, closures, or changes imposed by government authorities, site administrators, or official operators. Once issued, many permits and entrance tickets are non-refundable, non-transferable, and cannot be modified.
Kaymara will use reasonable efforts to secure the best available arrangements according to the Traveler’s preferences, but specific access times, circuits, train schedules, guide routes, or permits cannot be guaranteed unless confirmed by the competent authority or supplier.
30. Accommodation Standards and Supplier Variability
Kaymara carefully selects accommodations aligned with the style and standard of each journey, which may include boutique hotels, heritage properties, luxury lodges, remote retreats, cruise suites, wilderness camps, or iconic properties.
Accommodation classification, amenities, service standards, room size, heating, air conditioning, internet quality, water pressure, and accessibility may vary significantly by region, especially in remote or heritage destinations. Some properties may offer exceptional character, location, and authenticity rather than standardized urban luxury.
Specific room types, views, bed configurations, or connecting rooms are subject to availability and supplier confirmation. Kaymara will communicate preferences to suppliers but cannot guarantee requests unless expressly confirmed in writing.
31. Data Protection and Privacy
Kaymara treats Travelers’ personal information confidentially and in accordance with applicable data protection laws, including Peruvian Law No. 29733 on Personal Data Protection and, where applicable, principles consistent with the General Data Protection Regulation (GDPR), UK GDPR, and other relevant privacy frameworks.
Personal information may be collected and processed for purposes including trip design, reservations, operations, payments, communications, emergency assistance, supplier coordination, legal compliance, security, and service improvement. Travel bookings often require the sharing of personal information with Independent Suppliers, including hotels, airlines, rail operators, authorities, guides, insurers, payment processors, and local partners.
Depending on applicable law, Travelers may have rights to access, rectify, update, cancel, object to, restrict, or request information about the processing of their personal data. Requests may be sent to the email address indicated in the Contact section.
If a Traveler refuses to provide information required for travel arrangements, Kaymara may be unable to provide certain services or complete the booking.
32. Privacy and Use of Image
Kaymara respects the privacy and confidentiality of its guests as a fundamental value. No photograph, video, testimonial, name, likeness, voice, or personal travel story will be used for promotional, marketing, editorial, social media, or commercial purposes without the Traveler’s prior and express authorization.
Travelers who voluntarily tag Kaymara, submit testimonials, provide reviews, or share content with Kaymara may be asked for written permission before such content is reposted or used. Kaymara may, however, use non-identifiable operational images that do not reveal the identity of guests unless prohibited by law or prior agreement.
33. B2B Relationships, Travel Advisors, and Confidentiality
Rates, proposals, itineraries, supplier information, commercial terms, net pricing, commissions, partnership structures, and conditions communicated to agencies, travel advisors, tour operators, concierges, destination specialists, and strategic partners are strictly confidential and may be used only for the authorized commercial purpose.
Specific B2B conditions may be regulated through separate written agreements. In the event of conflict between these Terms and a specific B2B agreement, the specific commercial agreement shall prevail to the extent of such conflict.
B2B partners are responsible for ensuring that their clients receive and accept the applicable booking terms, cancellation policies, insurance requirements, and operational conditions.
34. Responsible and Sustainable Travel
Kaymara operates under a model of responsible, sustainable, and culturally respectful tourism. We are committed to supporting local communities, preserving cultural heritage, respecting natural environments, and promoting thoughtful travel practices.
Travelers are expected to behave consistently with these values throughout the journey. This includes respecting local customs, asking permission before photographing individuals where appropriate, following guide instructions, avoiding damage to archaeological sites, not disturbing wildlife, reducing waste, respecting community protocols, and acting with sensitivity in sacred or culturally significant spaces.
Kaymara may modify or cancel activities if community protocols, conservation requirements, or environmental protection measures so require.
35. Website Content, Intellectual Property, and Proposals
All website content, itineraries, descriptions, photographs, text, brand elements, route concepts, journey names, proposal structures, and creative materials produced by Kaymara are protected by intellectual property rights and may not be copied, reproduced, distributed, adapted, or used for commercial purposes without prior written permission.
Personalized proposals, itineraries, and journey concepts prepared by Kaymara are confidential and intended solely for the recipient. They may not be used to contract directly with suppliers, reproduce Kaymara’s designs, or develop competing commercial offerings without Kaymara’s authorization.
Information on the website is provided in good faith and for general inspiration. Errors, omissions, price changes, availability changes, or updates may occur, and Kaymara reserves the right to correct them before confirmation.
36. Complaints, Assistance, and Service Issues
If a Traveler experiences a concern during the journey, they must notify Kaymara or the local representative as soon as reasonably possible so that Kaymara may have the opportunity to assist, correct, mitigate, or address the matter during travel.
Failure to notify Kaymara promptly may limit Kaymara’s ability to resolve the issue and may affect any subsequent claim. Complaints submitted after the trip should be sent in writing within thirty (30) calendar days of the end of the journey, including relevant details and supporting documentation.
Kaymara will review concerns in good faith and work toward an appropriate resolution in accordance with these Terms and applicable law.
37. Force Majeure
Kaymara shall not be responsible for modifications, interruptions, cancellations, delays, losses, damages, or failure to perform caused by Force Majeure or by circumstances beyond its reasonable control.
In such situations, Kaymara will act in good faith to reorganize, adapt, postpone, or substitute services where reasonably possible, prioritizing the safety and wellbeing of Travelers. Additional costs arising from Force Majeure, including accommodation, transport, evacuation, alternative routing, medical assistance, or extended stay costs, shall be the responsibility of the Traveler unless recoverable from suppliers or covered by insurance.
38. Governing Law and Dispute Resolution
These Terms & Conditions shall be governed by the laws of the Republic of Peru.
The parties shall seek to resolve any dispute amicably through direct communication, customer service channels, the Complaints Book where applicable, conciliation, mediation, or arbitration where appropriate. If no agreement is reached, disputes shall be submitted to the competent authorities or courts in accordance with Peruvian law, unless mandatory consumer protection rules provide otherwise.
Nothing in this clause limits any non-waivable rights that a Traveler may have under applicable consumer protection laws.
39. Digital Acceptance
Acceptance of these Terms by online checkbox, email confirmation, written confirmation, payment, electronic signature, booking form, digital platform acceptance, or any other verifiable digital means shall have full legal validity and binding effect, in accordance with applicable law, including Article 141-A of the Peruvian Civil Code where applicable.
The Traveler agrees that electronic communications, digital confirmations, and electronic records may be used as evidence of acceptance, booking, payment, and contractual communications.
